CREATING A BREEDING GROUND FOR ONE CHILD TO INFLUENCE INHERITANCE DECISIONS

Problem:

Child who is a care taker or living with ailing parent “deserves” more for that child’s allegiance to the exclusion of other siblings; Caretaker child has accounts in joint title with parent; manipulation of children living near parent in their favor over children living in another state.  No outside conservator to care for the parent to avoid undue influence.  Other children will sue for undue influence

Solutions:

Having objective advisors to discuss allocation issues with aging parents in private

Discussions with children as to what to expect

Private investigation by long distance relatives to oversee potential undue influence

Use of third party trustee/conservator to eliminate subjective changes
